Das Harvard-Konzept ist eine Verhandlungsmethode, die von Roger Fisher und William Ury an der Harvard Law School im Rahmen des Harvard Negotiation Project entwickelt wurde und durch das gleichnamige Buch weite Verbreitung erfahren hat. Bereits zwei Jahre nach seiner Veröffentlichung im Jahr 1981 war das Harvard-Konzept in zehn Sprachen erhältlich und wurde schon eine Viertelmillionen Mal verkauft. Auch in der heutigen Zeit ist es mit über 2 Millionen verkauften Exemplaren eines der erfolgreichsten Verhandlungsbücher aller Zeiten.
In § 779 BGB ist der Vergleich zweier Parteien als beiderseitiges Nachgeben definiert. Die Methode des Harvard-Konzepts verfolgt im Gegensatz dazu, getreu dem englischen Titel des Buches Getting to Yes: without giving in, das Ziel, neue Lösungsmöglichkeiten zu schaffen, die für beide Parteien vorteilhaft sind (Win-Win-Situation), so dass keine der Parteien nachgeben muss. Als Grundsatz dient dabei das sachbezogene Verhandeln (principled negotiation), um mit diesem, alle Anstrengungen der Parteien auf das Finden neuer Lösungen zu konzentrieren.
