Meist stellen Grenzstreitigkeiten, konkurrierende Gebietsansprüche oder ein ethnisch heterogenes Staatsvolk Hauptquellen für wachsende Feindseligkeiten dar. Diesem Problem begegneten Staaten in der Geschichte oft mit kriegerischen Mitteln, wovon das uti possidetis-Prinzip eine prominente Ausnahme ist. Es wurde innerhalb der letzten zwei Jahrtausende in immer wieder wechselnden Formen als gewaltverhinderndes Mittel nutzbar gemacht. Aktuell erschließen sich ihm durch Entwicklungen auf dem europäischen Kontinent in modifizierter Form wieder neue Anwendungsgebiete. Diese Kolloquiumsarbeit wird die Entwicklung des uti possidetis-Prinzips von seinen Ursprüngen im römischen Recht über seine Anwendung in Lateinamerika, Afrika und Europa skizzieren, auf die Frage seiner Rechtsqualität eingehen, sein Zusammenspiel mit dem Selbstbestimmungsrecht der Völker darstellen und mögliche Weiterentwicklungen aufzeigen.


A. Ursprung des uti possidetis-Prinzips

Von der römischen Spätantike bis heute wird mit dem durchgehend verwendeten Begriff des uti possidetis Unterschiedliches verbunden. Die begrifflich vorgespiegelte Kontinuität wird bei der Erschließung eines neuen Anwendungsgebiets immer wieder durchbrochen.

Das uti possidetis-Prinzip leitet sich von einer römischen Rechtsfigur des Immobiliarsachenrechts ab. Diese Rechtsfigur regelte bei einem Eigentumsstreit über ein Grundstück, wer das Grundstück während des laufenden Verfahrens besitzen durfte, solange noch nicht abschließend über das Eigentumsrecht geurteilt worden war. So wurde vorläufig erstens der rechtmäßige Besitzer vor Besitzstörungen geschützt und zweitens die Wiederbemächtigung gegenüber einem fehlerhaften Besitzer erlaubt.

Dieses Prinzip wurde in der Neuzeit im Kriegsvölkerrecht für die rechtliche Zuweisung von im Krieg annektierten Gebieten aufgegriffen und in einem entscheidenden Punkt zugunsten des Staates, der nach dem Krieg Territorialgewinne zu verzeichnen hatte, verändert. Demnach sollte der Staat das, was er nach dem Krieg besitzt, weiter besitzen dürfen. Auf die nach dem römisch-rechtlichen uti possidetis eigentlich darauf zu folgende endgültige Klärung der rechtmäßigen Eigentumsposition wurde nunmehr verzichtet.
