V. m. Art. 3 EGV). Nach Art. 14 EGV umfasst der Binnenmarkt einen Raum ohne Binnengrenzen, in dem der freie Verkehr von Waren, Personen, Dienstleistungen und Kapital gewährleistet wird. Nach dem Subsidiaritätsprinzip in Art. 5 EGV wird die Gemeinschaft in den Bereichen, die nicht in ihre ausschließliche Zuständigkeit fallen nur tätig, „sofern und soweit die Ziele der in Betracht gezogenen Maßnahmen auf Ebene der Mitgliedsstaaten nicht ausreichend erreicht werden können und daher wegen ihres Umfangs oder ihrer Wirkungen besser auf Gemeinschaftsebene erreicht werden könnten.“ Da die Errichtung eines europäischen Energiebinnenmarktes nicht allein einzelstaatlich möglich ist, erhält die Europäische Gemeinschaft in diesem Bereich die Berechtigung für hoheitliches Handeln.

Die Elt-RL 96/92/EG und die Gas-RL 98/20/EG haben nach Auffassung der Kommission einen „wesentlichen Beitrag zur Schaffung eines einheitlichen Binnenmarktes geleistet.“ Um eine weitere Liberalisierung des Energiemarktes voranzutreiben und unter anderem die Schwächen im Bereich des Netzzugangs und der Entflechtung zu beseitigen, wurden die bis dahin geltenden Richtlinien durch die Beschleunigungsrichtlinien 2003/54/EG zum Elektrizitätsbinnenmarkt und 2003/55/EG zum Erdgasbinnenmarkt ersetzt. Die in den Beschleunigungsrichtlinien verfolgten Ziele liegen in der „Errichtung eines wettbewerbsorientierten, sicheren und unter ökologischen Aspekten nachhaltigen Elektrizitäts- bzw. Erdgasmarkts in Europa.“ Festzustellen ist, dass trotz der Umsetzung der Beschleunigungsrichtlinien bis dato ein unzureichender Wettbewerb auf dem Energiemarkt vorherrscht. Zur Beseitigung der genannten Schwächen fordert die Kommission deshalb strengere Entflechtungsvorschriften. Dabei schlägt sie zwei Verfahren vor: Zum einen die von der Kommission bevorzugte Option der eigentumsrechtlichen Entflechtung und zum anderen die Einrichtung eines „Independent System Operator“.
